Locafy Limited (ACN 136 737 767) (“Locafy”, “we”, “us” or “our”) is a public company listed on the Nasdaq Stock Market (ticker: LCFY). Locafy owns and operates Scoop.com.au (“Scoop”), an Australian lifestyle directory that helps people discover restaurants, places to visit, things to do and local experiences. Scoop is a brand operated by Locafy, and references in this Privacy Policy to “Scoop”, “the Services” or “the website” are references to services provided by Locafy.
This Privacy Policy explains what personal information we collect, why we collect it, how we use and disclose it, and the choices and rights you have in relation to it.
This Privacy Policy applies to visitors who browse Scoop.com.au, consumers who create an account or submit a review, and businesses that enquire about or hold a listing on Scoop (together, “you”).
By using Scoop.com.au, you consent to Locafy’s collection, use and disclosure of your personal information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the website or services.
1. This policy and Australian law
This Privacy Policy has been developed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where we handle personal information of individuals located overseas (for example, in the European Union, United Kingdom or United States), we also have regard to the EU General Data Protection Regulation and UK GDPR to the extent they apply.
Under the Privacy Act, “personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not, and whether it is recorded in a material form or not.
We may update this Privacy Policy from time to time to reflect changes to our practices or legal requirements. We will post the updated version on this page with a revised “Last updated” date. Your continued use of Scoop.com.au after any changes take effect constitutes your acceptance of the revised policy.
2. Personal information we collect
The personal information we collect depends on how you interact with Scoop.com.au. This includes:
2.1 Account and user signups
When you create a Scoop account, we collect information such as your name, email address, password, and optionally your location or suburb, and any profile details you choose to add. We use this information to create and manage your account, personalise your experience, and communicate with you.
2.2 Review submissions
When you submit a review, rating, comment, photo, or other content about a restaurant, venue, activity or business listed on Scoop, we collect the content of that submission together with your account details, the date and time of submission, and, where available, technical information such as your IP address and device type, which we may use to verify authenticity and prevent fraudulent or fake reviews.
Reviews and any name or profile image associated with your account may be displayed publicly on Scoop.com.au. Please do not include sensitive or identifying information about yourself or others in a review that you would not want made public.
2.3 Business listing inquiries
When a business enquires about, claims, updates or advertises a listing on Scoop, we collect information such as the business name, ABN, contact person’s name, email address, phone number, business address, and any details submitted through an inquiry, claim or advertising form. We use this information to respond to the enquiry, manage the listing, provide customer support, and, where applicable, process payment for advertising or premium listing services.
2.4 Automatically collected information and analytics
When you browse Scoop.com.au, we and our analytics providers automatically collect technical and usage information, including your IP address, browser type, device identifiers, pages viewed, search terms, referring website, and the date, time and duration of your visit. We use this information to understand how the site is used, diagnose technical issues, improve our content and search results, and measure the performance of the directory.

3. How we use your personal information
We use personal information we collect to:

- Respond to business listing inquiries and manage advertising or premium listing arrangements;

- Serve and measure advertising, including through third-party advertising and analytics partners;
- Communicate with you about your account, submissions, or enquiries, and, where you have not opted out, send you marketing communications in accordance with the Spam Act 2003 (Cth);
- Detect, investigate and prevent fraud, fake reviews, spam and misuse of the Services; and
- Comply with our legal obligations and enforce our Terms and Conditions.
You may opt out of receiving marketing communications from us at any time using the unsubscribe link included in each message, or by contacting us using the details in section 13.
4. Cookies and similar technologies
Scoop.com.au uses cookies, tags, pixels, local storage and similar technologies (“cookies”) to make the site work, remember your preferences, understand how the site is used, and support advertising.
The categories of cookies we use include:

- Locafy’s related bodies corporate, subsidiaries and affiliated brands, or a purchaser, in connection with a sale, merger, restructure or transfer of all or part of our business or assets;
- Law enforcement, regulators or courts, where required or authorised by law, or where we reasonably believe disclosure is necessary to protect our rights, users or the public; and
- Any other party where you have given your consent.
We do not sell your personal information to third parties for their own independent marketing purposes.
7. Overseas disclosure
As Locafy is listed on the Nasdaq Stock Market and operates internationally, some of our service providers, including hosting and analytics providers, may store or process personal information outside Australia, including in the United States or other jurisdictions. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, to the extent required by law.
8. Data retention
We retain personal information for as long as needed to provide the Services, including keeping your account, reviews and listing enquiry details for as long as your account or listing remains active, and for a reasonable period afterwards to comply with legal, accounting, dispute resolution or fraud-prevention requirements. Where information is no longer needed for these purposes, we take reasonable steps to delete, destroy or de-identify it.
9. Security
We use reasonable technical and organisational measures to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
If we become aware of a data breach involving personal information that is likely to result in serious harm, we will assess the breach and, where required, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme under the Privacy Act.
10. Children
Scoop.com.au is intended for a general audience and is not directed at children. We do not knowingly collect personal information from individuals under the age of 16. If you believe a child has provided us with personal information, please contact us and we will take reasonable steps to delete it.
11. Access, correction and your rights
You may request access to, or correction of, the personal information we hold about you by contacting us using the details below. We will respond within a reasonable time and, subject to any legal exceptions, provide access to or correct your information. We will not charge you for making a request, though we may charge a reasonable fee to cover the cost of providing access in some circumstances.
You may also request that we delete your account or personal information, subject to any information we are required or permitted by law to retain.
12. Complaints
If you have a concern about how we have handled your personal information, please contact us using the details in section 13 and provide sufficient detail for us to investigate. We will acknowledge your complaint, investigate it, and aim to respond with an outcome within a reasonable time. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner at www.oaic.gov.au.
